Court stops NERC from implementing tariff hike for Band A customers

A federal high court in Kano has ordered the National Electricity Regulatory Commission (NERC) and the Kano Electricity Distribution Company (KEDCO) not to implement the new electricity tariff for Band A consumers.

The judge, Abdullahi Liman, ruling on an ex parte motion on Thursday, issued an interim order to stop NERC and KEDCO from going ahead with the new tariff pending the hearing and determination of the motion.

The order also restrained both NERC and KEDCO from intimidating and threatening to disconnect the applicants’ electricity supply for non-acceptance of the new tariff.

Five companies, Super Sack Company Limited, BBY Sacks Limited, Mama Sannu Industries Limited, Dala Foods Nigeria Limited, and Tofa Textile Limited as well as the Manufacturers Association Of Nigeria Limited (MAN) filed the suit marked FHC/KN/CS/144/2024.


Counsel to the plaintiffs, Abubakar Mahmoud, moved the motion ex-parte.

NERC on April 3 said N225 will be charged for Kilowatt per hour for about 15 per electricity Band A customers.

NERC said the increase will not affect band B to E customers, adding that some customers previously on band A have been downgraded.


NERC Vice Chairman, Musiliu Oseni said the number of feeders on band A, which was over 900 did not qualify and has now been downgraded.

NERC said the increase in tariff will only affect customers enjoying at least 20 hour power supply across Nigeria.
