Court sacks APC exco in Taraba, ordered for fresh Congress

The Federal High Court sitting in Jalingo, Taraba state , on Tuesday , urged the executive of the state chapter of the All Progressives Congress (APC) , to desist from parading themselves as the leaders of the party.

Moving ahead to nullified the state Congress that brought them on board, the court urged the party to as a matter of urgency embark on a fresh Congress for the state.

Some aggrieved members, who were not pleased with the outcome of the state Congress which took place last October, were observed to have approached the court for justice.

Delivering the judgement which last over three hours, the presiding judge, e presiding judge, Simon Amonbita, said the defendants who includes the state Congress committee and the newly elected state executive have violated the rights of the plaintiffs by not allowing them to participate in the Congress.

The plaintiffs who despite purchasing forms to contest for various executive position on the platform of the APC, were alleged to have been denied the opposite of participate, the action which the judge described as ” undemocratic”.

The judge who also could not fathomed why the leadership of the party went as far as violating both the.constitution and the guidelines of the party, said the need for him to declare the said Congress “illegal”can no longer be overemphasized.

Citing different portions of the party’s constitution, and other authorities, for the party to have conducted the Congress outside the state Secretariat , he believed was uncalled for.

He also expressed sadness at the alleged refusal of the party’s leadership to make public the date and venue of the Congress, which he noticed was.conducted via affirmation in a private farm outskirt of the state capital.

Applauded the judgement, the counsel to the plaintiffs, Joy Ezekiel, admitted that justice was dispensed towards the right direction, adding that it would go a long to serve as detterant to party leaders who drives joy in suppressing their members.

On his.part, the counsel to the defendants, John Odekina ,who was visibly not comfortable with the ruling , said his clients will not hesitate to approach the appeal court.

Some of the plaintiffs who spoke with The Guardian shortly after the ruling, agreed that the.court is indeed the last hope of the.common man,stating that “this court has not only vindicated us, but has as well wipe away our tears.”

None of the defandants could be reached for comments as at the time of filing this report our correspondence calls were all ignored .
