Court restrains FCTA from demolishing Trademore estate

A High Court has restrained the Federal Capital Territory Administration (FCTA) from demolishing the Trademore estate located in the Lugbe area of Abuja.

The Court sitting in Jikwoyi in the Federal Capital Territory on Wednesday granted an order of interim injunction.

Justice Zubairu Mohammed granted the developers of Trademore International Holding Nigeria Ltd an order for maintenance of the status quo.

The order was granted after hearing the ex-parte application argued by Benson Igbanoi, Esq and Vivian Oluchi Uche who were holding brief for the plaintiff’s counsel, Mike Ozekhome (SAN).

Ozekhome had, on behalf of the estate, filed the suit against some functionaries and agencies of the FG who had threatened to demolish the estate over flooding concerns.

The FCTA had declared the estate a disaster area in the wake of massive floodings on June 23, 2023 which left residents trapped and houses submerged.

Officials of the FCTA said that the buildings on the waterways in the estate and other areas in Abuja would be demolished.

The FCTA in a statement signed by its executive secretary, Shehu Ahmed, said some structures are preventing water from flowing freely through its natural course, hence, the flooding in some parts of the city.

But in the writ of summons filed by Ozekhome, the developers amongst other reliefs, urged the court to restrain the respondents, the Minister of FCT, the FCDA, the Abuja Metropolitan Management Council and the Abuja Municipal Area Council from demolishing the estate.
